recourse, its participation percentage in each loan at <br /> the time of loan funding as outlined in Part Two and <br /> Three of this Agreement. <br /> <br />B. The information contained in the loan application <br /> package, shall be held by the AGENCY as privileged and <br /> confidential documents and not as public record. AGENCY <br /> warrants that CCF shall be held harmless from any acts of <br /> the AGENCY'S employees in the course of the loan process <br /> that may be in violation of State and/or Federal credit <br /> grant statutes and regulations. <br /> <br />C. CCF shall ~e fully justified in accepting and acting upon, <br /> without investigation, any certificate, statement, <br /> opinion, notice of demand furnished to it pursuant to the <br /> provisions of this Agreement and which CCF shall in good <br /> faith believe to have been fully authorized and executed <br /> on behalf of the party in whose name it purports to have <br /> been executed. <br /> <br />D. AGENCY shall indemnify and hold harmless CCF and/or its <br /> Agent, against all claims and damages, alleged or <br /> otherwise, or whatsoever nature arising out of, or in any <br /> way connected with, the acts or omissions of any private <br /> Contractor peforming rehabilitation work for Borrower in <br /> connection with this Agreement; provided however, that <br /> AGENCY'S obligation under this paragraph shall not extend <br /> to grossly negligent or willful acts or omissions by CCF. <br /> All contractors shall operate as independent contractors <br /> and nothing herein is intended to affect such independent <br /> contractor status. <br /> <br />E. AGENCY and CCF shall comply with all applicable statutes, <br /> regulation and ordinaces including the Federal Truth in <br /> Lending and Regulation Z thereto; the Equal Credit <br /> Opportunity Act and Regulation B thereto; Title VI, Civil <br /> Rights Act of 1964; and Title VIII, the Civil Rights Act <br /> of 1968. <br /> <br />F. The Parties will not discriminate against any loan <br /> applicant hereunder because of race, creed, sex, color, <br /> age or natural origin and will ensure that applicants are <br /> rated without regard to their race, creed, sex, color, <br /> age or natural origin. <br /> <br />G. CCF will establish and maintain an adequate accounting <br /> system on a current basis in accordance with any specific <br /> written reasonable requirements. All financial records <br /> and the like, relevant to this Agreement, shall be <br /> retained by CCF for a period of seven years. <br /> <br />H.
