DES:mmg n6/08/89 (#40/026) <br /> <br />once every four (4) weeks. Payments shall be for the invoiced <br />amount. <br /> <br /> (c) Limitation. Notwithstanding the provisions of <br />subparagraph (a) above, Harris shall not furnish services, nor <br />incur expenses, for any amount which will exceed Fifty Thousand <br />and No/100 Dollars ($50,000.00) without prior approval thereof by <br />City's City Council, evidenced by motion duly made and carried. <br /> <br /> 4. HARRIS' RESPONSIBILITIES. Harris agrees that it shall <br />use its best efforts and that its services shall be performed <br />with due diligence in accordance with generally accepted <br />engineering practices, but makes no other warranty either <br />express or implied. <br /> <br /> 5. CITY'S RESPONSIBILITY. The City shall provide all <br />reasonably available information including reports, preliminary <br />plans, maps, surveys and other related information regarding its <br />requirements for the work, upon written request to City or <br />Counsel. The City shall designate a representative who shall be <br />fully acquainted with the Project and have authority within limits <br />of existing City policy and the requirements of the law to render <br />decisions promptly and furnish information expeditiously. City <br />shall cooperate with Harris and provide reasonable access to all <br />records and property pertaining to the Project within the <br />possession of or under the control of City. <br /> <br /> 5. STATUS. In rendering its services pursuant hereto, <br />Harris in an independent contractor and not an employee of City <br />or Counsel. <br /> <br /> 4 <br /> <br /> <br />
