<br />insurance required hereunder and, with respect to evidence of comprehensive general <br />liability and automobile liability insurance (if applicable) coverage, original <br />endorsements: <br /> <br />(a) Precluding cancellation or redl'ction in coverage befon the expiration of <br />thirty (30) days after City shall have receiw~d written notification úf cancellation or <br />reduction in coverage by first class mail; <br />(b) Providing that Contractor's insurance shall apply separately to each <br />insured against whom claim is made or suit is brought, except with respect to the limits <br />of the insurer's liability (cross liability endorsement); <br />(c) Naming the City, its officers, boards, commissions, employees, and <br />agents, as additional insureds; and <br />(d) Providing that Contractor's insurance coverage shall be primary insurance <br />with respect to City, its officers, boards, commissions, employees, and agents, and any <br />insurance or self-insurance maintained by City for itself, its officers, boards, <br />commissions, employees, or agents shall be in excess of Contractor's insurance and <br />not contributory with it. <br /> <br />6. <br /> <br />NON-DISCRIMINATION <br /> <br />Contractor shall comply with the non-discrimination requirements described <br />below: <br /> <br />A. <br /> <br />Section 504 of the Rehabilitation Act of 1973 <br /> <br />(1) Pursuant to Section 514 (Public Law 93-112), the Contractor <br />agrees that no otherwise qualified persons with disabilities shall, solely by <br />reason of a disability, be excluded from the participation in, be denied benefits <br />of, or be subjected to discrimination in the performance of this contract or in the <br />selection of low income owners to purchase the dwelling to be built on the <br />"Property." <br /> <br />(2) Compliance of Section 504 of the Rehabilitation Act of 1973, as <br />amended, requires that all benefits, aids and services are made available to <br />persons with disabilities on an equivalent basis with those received by non- <br />disabled persons. Contractor shall agree to be in compliance with Section 504 <br />requirements by developing a plan for compliance to be submitted to the Section <br />504 Coordinator as soon as possible but not later than by the close of escrow for <br />this acquisition. <br /> <br />9/11/03 <br /> <br />4 <br /> <br />"'"'"H ""H" . ..--" , H""" . -..
