E. Interest of Public Officials. No members, officers, employees, or agents of City and no other public official who exercises any function or responsibility with respect to this Agreement or Contractor's Program during his or his tenure, or for one year thereafter, shall have any interest, direct or indirect, in this contract or a related subcontract, or the proceeds thereof. Contractor shall incorporate in all subcontracts hereunder a provision prohibiting such interest. F. Reliaious Activity Prohibited. Those shall be no religious worship, instruction, or proselytizing as part of, or in connection with, the performance of this Agreement. G. Uniform Administration Reauirements. Contractor shall comply with the requirements and standards of the HOME Investment Partnership Regulations, OMB Circular A-122 Cost Principles for Non-Profit Organizations, OMB Circular A-11 0 attachments A, B, C, F, H, N, and 0, and all other federal, state, and local laws, regulations and requirements, as applicable. H. HOME PROGRAM Reauirements. Contractor shall comply with the requirements and standards of the HOME Investment Partnership Regulations relating to: income targeting to HOME limits of 50% and below median income; affordability term of no less than 30 years; Contractor shall set unit HOME rents at the rates listed below. Said rents shall not exceed 30% of the household's gross income. Monthly housing costs shall be defined as rent plus utilities. 7. ASSIGNMENT AND SUBCONTRACT Without the written consent of the City or its representative, this Agreement is not assignable in whole or in part. Any assignment by Contractor without the written consent of the City or its representative violates this Agreement and shall automatically terminate this Agreement. 8. RECORDS Contractor agrees to provide to City, and to any Federal or State department having monitoring or reviewing authority, and/or their appropriate audit agencies upon reasonable notice, access to and the right to examine and audit all records and documents necessary to determine compliance with relevant Federal, State, and local statutes, rules and regulations, and this Agreement, and to evaluate the quality, appropriateness and timeliness of services performed. 9/11/03 6 ,,"- ,",,"""- ,-, T"
