Hillsdale agrees that if, within a period of one (1) <br /> <br />year after final acceptance of the work done under this <br />agreement, any improvement or part of any improvement furnished <br />and/or installed or constructed or caused to be constructed by <br />Hillsdale or any of the work done under this agreement, fails to <br />fulfill any of the requirements of this agreement, or the plans, <br />provisions, and standard specifications referred to herein, <br />Hillsdale will upon receipt of a request in writing from City <br />directing the work to be done, without delay and without any cost <br />to City, repair or replace or reconstruct any defective or ~ <br />otherwise unsatisfactory part or parts of the improvement or OD <br />work. Should Hillsdale fail to act promptly to make such repair, ~ <br />replacement or reconstruction or to otherwise act in accordance <br />with this requirement to repair, replace or reconstruct, or <br />should the exigencies of the case require repair, replacement or <br />reconstruction to be made before Hillsdale can be notified, the <br />City may, at its option, make the necessary repair, replacement <br />or reconstruction or perform the necessary work and Hillsdale <br />shall pay to City the actual cost of such repair plus fifteen <br />percent (15%). <br /> <br /> 10. Hillsdale agrees, as a condition precedent to the <br /> <br />acceptance of any of the improvements which are the subject of <br />this agreement, to furnish and file with the City Clerk a good <br />and sufficient bond, deposit or instrument of credit in the <br /> <br /> 7 <br /> <br /> <br />
