<br />Contract Documents are at variance in any respect therewith, CM/GC shall promptly notify <br />City/Agency and Architect in writing, and necessary changes shall be developed by Architect. <br />CM/GC shall not be liable to City/Agency or Architect for damages resulting from variance in <br />Contract Documents with applicable laws, statutes, ordinances, building codes, and rules and <br />regulations unless CM/GC observed the variance and failed to promptly report it to City/Agency <br />and Architect. <br /> <br />2.1.7 Professional Consultants. CM/GC shall assist City/Agency, if requested, in selecting <br />and retaining the professional services of surveyors, special consultants and testing <br />laboratories, and coordinate the consultants' services throughout the Project. <br /> <br />2.2 <br /> <br />PLAN CHECK AND BIDDING PHASE. <br /> <br />2.2.1 <br /> <br />Separate Contracts (Multi-Prime Trade Contractinq). <br /> <br />.1 CM/GC shall be responsible for separating the Work and construction documents <br />and specifications into separate contracts for various categories of work ("Bid Packages"). <br />CM/GC shall advise on the methods to be used for selecting Trade Contractors and awarding <br />individual bids. CM/GC shall review the drawings and specifications to: (1) create bid packages <br />that clearly define and segregate the scope of work to insure completeness and to avoid <br />duplication; (2) coordinate the work of the Trade Contractors; (3) minimize the likelihood of <br />jurisdictional disputes; and (4) permit construction to be phased as necessary to be completed <br />within the Contract Time. <br /> <br />.2 CM/GC shall prepare for City/Agency's review bidding documents and forms of <br />agreement for the Trade Contractors, including general and special conditions. CM/GC shall <br />modify the bidding and contract documents as directed by the City/Agency. <br /> <br />2.2.2 Biddinq Procedures~ CM/GC shall develop procedures for expediting bid document <br />issuance, bid tracking and receipt of proposals for each Trade Contract that comply with the <br />Public Contract Code. CM/GC shall also follow City's/Agency's internal policies and procedures <br />for bidding and award of contracts. <br /> <br />Atty/Agr/2005.003 <br />030805/L.
