<br />2.2.3 Bid Inclusions. CM/GC shall insure that the bidding documents and Contract <br />Documents for the Trade Contractors include all of the provisions required in City/Agency <br />construction contracts, including at a minimum: <br /> <br />.1 That each contractor possesses a valid contractor's license at the time it submits <br />a bid and at all times during performance of the Work. <br /> <br />.2 <br /> <br />Applicable requirements for equal employment opportunity programs. <br /> <br />.3 That each Trade Contractor shall comply with all California Labor Code <br />requirements applicable to public works projects including, but not limited to, the payment of <br />prevailing wages, compliance with apprenticeship standards, overtime pay and certified payroll <br />obligations. <br /> <br />.4 That each Trade Contractor comply with all California Public Contract Code <br />requirements governing public works projects including, but not limited to, subcontractor listing, <br />the disabled veteran business enterprise participation goals, the substitution of securities in lieu <br />of retention funds and the execution of noncollusion affidavits. <br /> <br />2.2.4 Pre-Bid Conference(s). In conjunction with City/Agency, CM/GC shall conduct one or <br />more pre-bid conferences for each bid package unless City/Agency agrees to forego a pre-bid <br />conference on a particular Bid Package. These conferences will familiarize bidders with the <br />Project requirements, including but not limited to the bid documents, multiple prime trade <br />contracting, and schedule. <br /> <br />2.2.5 Bid Evaluation. CM/GC shall assist City/Agency in conducting bid openings and <br />evaluating Trade Contractors' bids for completeness, responsiveness and price, including <br />alternate prices and unit prices (if applicable). CM/GC shall make a written recommendation to <br />City/Agency with regard to the award of each Trade Contract. <br /> <br />2.2.6 Guarantee. CM/GC shall certify in writing that, except as identified in the certification, <br />the Bid Packages include all of the Work required to perform the Project. This guarantee will in <br />no way preclude CM/GC from the use of the Project's construction contingency in the case of <br />omitted scope. <br /> <br />Atty/Agr/2005.003 <br />030805/L.
