<br />V. <br /> <br />IV. <br /> <br />COMPENSATION: <br /> <br />All services provided by either CDF/County Fire or Redwood City <br />Fire Department under this Agreement shall be performed without <br />monetary compensation. The mutual advantages protections and <br />services afforded by this Agreement are mutually agreed to be <br />adequate compensation to both jurisdictions. Nothing herein, <br />however, shall be deemed to limit the right of either Redwood City <br />Fire Department or CDF/County Fire to seek recovery of expenses <br />and costs under applicable California law. <br /> <br />LIABILITY/HOLD HARMLESS: <br /> <br />Nothing in the provisions of this Agreement is intended to affect the <br />legal liability of either party to the contract by imposing a standard <br />of care different from the standard of care different from the <br />standard of care imposed by law. <br /> <br />Each party shall bear its own exposure for Worker's Compensation <br />on its own personnel while furnished to the other party, or <br />otherwise. Nothing herein, however, shall be deemed to limit the <br />right of the employing jurisdiction or its employees to seek recovery <br />by a civil action for any loss, cost, damages, or medical and <br />attorney fees which arise out of activities under this Agreement and <br />the laws of the State of California relating to Worker's <br />Compensation. <br /> <br />It is understood and agreed that neither Redwood City Fire <br />Department, nor any officer or employee thereof, is responsible for <br />any damage or liability, incurred through the sole negligence of <br />CDF incurred by reason of any act or omission by CDF, its officers <br />or employees under or in connection with any work, authority or <br />jurisdiction delegated to CDF under this Agreement. It is also <br />understood and agreed that, pursuant to Government Code Section <br />895.4, CDF shall fully indemnify and hold harmless Redwood City <br />Fire Department from any damage or liability caused by the sole <br />negligence, incurred by reason of any act or omission by CDF, its <br />officers or employees, under or in connection with any work, <br />authority or jurisdiction delegated to CDF under this Agreement. <br /> <br />It is understood and agreed that neither CDF nor any officer or <br />employee thereof, is responsible for any damage or liability incurred <br />through the sole negligence of Redwood City Fire Department <br />incurred by reason of any act or omission by Redwood City Fire <br />Department, its officers or employees, under or in connection with <br /> <br />3 <br /> <br />,._.. ~ . <br />
