Title to the Property was previously transferred to <br /> Peninsula Habitat for Humanity, a California non-profit corporation <br /> (the "Developer") pursuant to that certain Disposition and <br /> Development Agreement, recorded with the County Recorder of San <br /> Mateo County on , 2Q05, as Instrument No. <br /> (the "DDA") . <br /> B. Under the terms of the DDA, the Agency is entitled to <br /> cause the title to the Property, and any and all improvements <br /> thereon, to revest in the Agency in the event of one or more of <br /> certain specified defaults . The Agency represents the following: <br /> l . The Developer was declared by the Agency to be <br /> in default of the DDA in accordance with the provisions of Section <br /> ' S. 07 of the DDA. <br /> j <br /> I <br /> ; 2 . Notice was given by the Agency to the Developer <br /> ' � of the default claimed by the Agency, and the requisite notice <br /> � � period as provided in the DDA has expired without a cure of the <br /> default or defaults by the Developer.
