� <br /> � <br /> of the Developer' s obligations under the DDA were in default and <br /> was given as required by the terms of the DDA. <br /> C. The recordation of this Notice, under the express <br /> provisions of the DDA as set forth in Section 5 . 07 thereof, serves <br /> to revest the title to the Property in the Agency without. further <br /> action by the Agency. Recordation of this Notice constitutes <br /> conclusive and binding evidence of revesting of title to the <br /> Property and any improvements thereon in the name of the Agency. <br /> Under the provisions of Section 5 .07 . f, subsequent purchasers, <br /> lessees or lienholder may not be subjected to any claim by the <br /> Developer as to the Property or any improvements thereon. <br /> D. The recording of this Notice shall not defeat, render <br /> invalid or limit: <br /> l . Any mortgage, deed of trust or other security <br /> interest permitted by the terms of the DDA; <br /> 2 . Any rights or interests provided in the DDA for <br /> the protection of holders of permitted mortgages, deeds of trust or <br /> other security interests; <br /> 3 . Any leases, declarations of covenants, <br /> conditions and restrictions, easement agreements or other recorded <br /> documents applicable to the Property, which were permitted under <br /> the terms of the DDA. <br /> E.
