a <br /> (1) The Declarant agrees to not discriminate <br /> against any employee or applicant for employment because of race, <br /> religion, color, national origin, ancestry, sex, age, physical or <br /> mental disability, marital status, sexual preference, or political <br /> affiliation. The Declarant agrees to take affirmative action to <br /> ensure that applicants are considered for employment, and that <br /> employees are treated during employment, without regard to their <br /> race, religion, color, national origin, ancestry, sex, age, <br /> physical or mental disability, marital status, sexual preference, <br /> or political af f iliation. Such action shall include, but not be <br /> limited to the following: employment, upgrading, demotion or <br /> transfers; recruitment or recruitment advertising; layoff or <br /> termination; rates of pay or other forms of compensation; and <br /> selection for t raining, including apprenticeship. The Declarant <br /> agrees to post in conspicuous places, available to employees and <br /> applicants for employment, notices to be provided by the City of <br /> Redwood City setting forth the provisions of this Fair Employment <br /> Practices section. <br /> (2) The Declarant agrees to permit access to <br /> its records of employment, employment advertisements, application <br /> forms, and other pertinent data and records by the State Fair <br /> Employment Practices Commission, or any other agency of the State <br /> of California designated by the awarding authority, for the <br /> purposes of investigation to ascertain compliance with the Fair <br /> Employment Practices section of this Declaration. <br /> (g) Nondiscrimination Based on Disabilitv. The <br /> Declarant hereby agrees that it will, to the extent not otherwise <br /> exempt, comply with the provisions of Section 504 of the <br /> Rehabilitation Act of 1973, as amended, providing equal access and <br /> reasonable accommodations in employment programs and services to <br /> persons who are disabled. <br /> (h) Interest of Public Officials . No members, <br /> officers, employees, or agents of the City of Redwood City, no <br /> member of the City Council and no other public official who <br /> exercises any function or responsibility with respect to this <br /> Agreement during his or her tenure, or for one year thereafter, <br /> shall have any interest, direct or indirect, in this contract or a <br /> related subcontract, or the proceeds thereof. The Declarant shall <br /> incorporate in all subcontracts hereunder a provision prohibiting <br /> such interest . <br /> (i) Reliqious Activity Prohibited. The Declarant <br /> -4- <br />
