a (1) The Declarant agrees to not discriminate against any employee or applicant for employment because of race, religion, color, national origin, ancestry, sex, age, physical or mental disability, marital status, sexual preference, or political affiliation. The Declarant agrees to take affirmative action to ensure that applicants are considered for employment, and that employees are treated during employment, without regard to their race, religion, color, national origin, ancestry, sex, age, physical or mental disability, marital status, sexual preference, or political af f iliation. Such action shall include, but not be limited to the following: employment, upgrading, demotion or transfers; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for t raining, including apprenticeship. The Declarant agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided by the City of Redwood City setting forth the provisions of this Fair Employment Practices section. (2) The Declarant agrees to permit access to its records of employment, employment advertisements, application forms, and other pertinent data and records by the State Fair Employment Practices Commission, or any other agency of the State of California designated by the awarding authority, for the purposes of investigation to ascertain compliance with the Fair Employment Practices section of this Declaration. (g) Nondiscrimination Based on Disabilitv. The Declarant hereby agrees that it will, to the extent not otherwise exempt, comply with the provisions of Section 504 of the Rehabilitation Act of 1973, as amended, providing equal access and reasonable accommodations in employment programs and services to persons who are disabled. (h) Interest of Public Officials . No members, officers, employees, or agents of the City of Redwood City, no member of the City Council and no other public official who exercises any function or responsibility with respect to this Agreement during his or her tenure, or for one year thereafter, shall have any interest, direct or indirect, in this contract or a related subcontract, or the proceeds thereof.
