As part of its marketing efforts, the Developer shall <br /> provide notice of opportunity to purchase and/or opening of waiting <br /> lists to Fair Oaks Community Center, a CORE Referral agency for San <br /> Mateo County Human Services operation. <br /> 4 . Lobbying Prohibited. The Developer shall not <br /> use HOME funds for publicity or propaganda purposes designed to <br /> support or defeat legislation pending before federal, state, or <br /> local government . HOME funds shall not be used by Developer to <br /> inf luence an of f icer or employee of any agency, a Member of <br /> Congress, and officer or employee of Congress, or an employee of a <br /> Member of Congress in connection with the awa�d of any Federal <br /> contract . <br /> d. Recording of Instruments Relatina to Sale of Units . <br /> Upon selection of a Qualified Buyer, the Developer shall <br /> cause the recordation of the following instruments to be executed <br /> by such Qualified Buyer prior to conveyance of the applicable <br /> residential unit : 1) Grant Deed conveying applicable residential <br /> unit to Qualified Buyer; 2) Addendum to Grant Deed, Restrictions <br /> for Affordable Ownership Housing; 3) Deed of Trust with Assignment <br /> of Rents as Additional Security; and 4) Addendum to Deed of Trust . <br /> Said documents shall be substantially in the form attached hereto <br /> as Exhibit "J" and incorporated herein by reference as the <br /> "Purchase Documents" . <br /> The parties acknowledge that the Purchase Documents are <br /> necessary in order to formalize and secure the Agency' s and the <br /> City' s Right of First Refusal in the event the Qualified Buyer <br /> desires to sell its unit . <br /> Section 4 . 02 . Maintenance of the Property. The <br /> Developer covenants and agrees for itself, its successors, its <br /> assigns, and every successor in interest to any portion of the <br /> Property until the sale of all the units, that the Developer, such <br /> successors and such assigns shall maintain in good condition the <br /> improvement s on the Property, shal l keep the Property f ree f rom any <br /> accumulation of debris or waste material, subject to normal <br /> construction job-site conditions, and shall maintain in a neat, <br /> orderly, healthy and good condition the landscaping required to be <br /> planted in accordance with the Scope of Development .
