maintenance as required herein, the Agency and/or the City shall
<br /> have the right, but not the obligation, to enter the Property and
<br /> undertake such maintenance activities . In such event, the
<br /> Developer shall reimburse the Agency and/or City for all reasonable
<br /> sums incurred by it for such maintenance activities. Additionally,
<br /> Developer will be obligated to submit an HOA budget for the units
<br /> comprising the Project to the Agency for the Agency' s approval .
<br /> The budget shall identify HOA maintenance responsibilities and the
<br /> amount of dues to be collected from the property owners to fund
<br /> each item.
<br /> Section 4 . 03 . Obliqation to Refrain from Discrimination.
<br /> The Developer covenants and agrees for itself, its successors, its
<br /> assigns and every successor in interest to the Property, or any
<br /> part thereof until the sale of all the units, that there shall be
<br /> no discrimination against or segregation of any person, or group of
<br /> persons, on account of sex, marital status, race, color, religion,
<br /> creed, national origin, ancestry, sexual orientation or domestic
<br /> arrangement in the sale, lease, sublease, transfer, use, occupancy,
<br /> tenure or enjoyment of the Property or in the operation of the
<br /> Project located thereon; nor shall the Developer, itself or any
<br /> person claiming under or through it, establish or permit any such
<br /> practice or practices of discrimination or segregation with
<br /> reference to the selection, location, number, use or occupancy of
<br /> tenants, lessees, subtenants, sublessee or vendees of the Property.
<br /> Section 4 . 04 . Form of Nondiscrimination and
<br /> Nonsectregation Clauses .
<br /> All deeds, leases or contracts pertaining to the Property
<br /> or the Project shall contain or be subject to substantially the
<br /> following nondiscrimination or nonsegregation clauses:
<br /> a. In deeds: "The grantee herein covenants by and for
<br /> itself, its successors and assigns, and all persons claiming under
<br /> or through them, that there shall be no discrimination against or
<br /> segregation of, any person or group of persons on account of race,
<br /> color, creed, religion, sex, marital status, national origin,
<br /> ancestry, sexual orientation or domestic arrangement in the sale,
<br /> lease, sublease, transfer, use, occupancy, tenure, or enjoyment of
<br /> the premises herein conveyed, nor shall the grantee or any person
<br /> claiming under or through it, establish or permit any such practice
<br /> or practices of discrimination or segregation with reference to the
<br /> selection, location, number, use or occupancy of tenants, lessees,
<br /> subtenants, sublessee, or vendees in the premises herein conveyed.
<br /> The foregoing covenants shall run with the land."
