Upon selection of a Qualified Buyer, the Developer shall <br /> cause the recordation of the following instruments to be executed <br /> by such Qualified Buyer prior to conveyance of the applicable <br /> residential unit : 1) Grant Deed conveying applicable residential <br /> unit to Qualified Buyer; 2) Addendum to Grant Deed, Restrictions <br /> for Affordable Ownership Housing; 3) Deed of Trust with As_signment <br /> of Rents as Additional Security; and 4) Addendum to Deed of Trust . <br /> Said documents shall be substantially in the form attached hereto <br /> as Exhibit "J" and incorporated herein by reference as the <br /> "Purchase Documents" . <br /> The parties acknowledge that the Purchase Documents are <br /> necessary in order to formalize and secure the Agency' s and the <br /> City' s Right of First Refusal in the event the Qualified Buyer <br /> desires to sell its unit . <br /> Section 4 .02 . Maintenance of the Propertv. The <br /> Developer covenants and agrees for itself, its successors, its <br /> assigns, and every successor in interest to any portion of the <br /> Property until the sale of all the units, that the Developer, such <br /> successors and such assigns shall maintain in good condition the <br /> improvements on the Property, shall keep the Property free from any <br /> accumulation of debris or waste material, subject to normal <br /> construction job-site conditions, and shall maintain in a neat, <br /> orderly, healthy and good condition the landscaping required to be <br /> planted in accordance with the Scope of Development .� In the event <br /> the Developer, or its successors or assigns, fails to perform the <br /> maintenance as required herein, the Agency and/or the City shall <br /> have the right, but not the obligation, to enter the Property and <br /> undertake such maintenance activities . In such event, the <br /> Developer shall reimburse the Agency and/or City for all reasonable <br /> sums incurred by it for such maintenance activities. Additionally, <br /> Developer will be obligated to submit an HOA budget for the units <br /> comprising the Project to the Agency for the Agency' s approval. <br /> The budget shall identify HOA maintenance responsibilities and the <br /> amount of dues to be collected from the property owne,rs to fund <br /> , <br /> each item. <br /> , Section 4 . 03. Obligation to Refrain from Discrimination. <br /> The Developer covenants and agrees for itself, its successors, its <br /> assigns and every successor in interest to the Property, or any <br /> part thereof until the sale of all the units, that there shall be <br /> � no discrimination against or segregation of any person, or group of <br /> i <br /> ! persons, on account of sex, marital status, race, color, religion, <br /> � ; creed, national origin, ancestry, sexual orientation or domestic <br /> ; � arrangement in the sale, lease, sublease, transfer, use, occupancy, <br /> tenure or enjoyment of the Property or in the operation of the <br /> Project located thereon; nor shall the Developer, itself or any <br /> REDW\0006\DOC\013-6 <br /> 3 0 3/08/05 mvc <br />
