permit any such practice or practices of discrimination or <br /> segregation with reference to the selection, location, number, use, <br /> or occupancy, of tenants, lessees, sublessees, subtenants, or <br /> vendees of the premises herein transferred. " The foregoing <br /> provision shall be binding upon and shall obligate the contracting <br /> party or parties and any subcontracting party or parties, .or other <br /> transferees under the instrument . <br /> Section 4 . 05 . Affordability Covenants . The Declaration <br /> of Affordability Covenants which shall be recorded against the <br /> Property sha�l contain covenants which shall require the Property <br /> to be available for sale to and occupied by Qualified Buyers, as <br /> specified in Section 4 . 01 of the Agreement, and with costs to be at <br /> an affordable housing cost (as such term is defined in Health & <br /> Safety Code Section 50052 .5) . <br /> Section 4 . 06. Nondiscrimination and Related Covenants <br /> Required by Federal Law. The Developer agrees that the covenants <br /> set forth in this Section 4 .06 shall bind it, for itself and its <br /> successors and assigns, and all subsequent holders of any interest <br /> in the Property. The federally required covenants set forth in <br /> this Section 4 . 06 shall be covenants running with the land and <br /> shall consist of the following: <br /> a. Section 504 of the Rehabilitation Act of 1973 <br /> (1) Pursuant to Section 514 (Public Law 93-112) , to the <br /> extent not otherwise exempted by applicable law, the Developer <br /> agrees that no otherwise qualified persons with disabilities shall, <br /> solely by reason of a disability, be excluded from the <br /> participation in, be denied benefits of, or be subjected to <br /> discrimination in the performance of this contract or in the <br /> selection of low income owners to purchase the dwelling to be built <br /> on the Property. <br /> (2) Compliance of Section 504 of the Rehabilitation Act <br /> of 1973, as amended, requires that all benefits, aids and services <br /> are made available to persons with disabilities on an equivalent <br /> basis with those received by non-disabled persons. The Developer <br /> shall agree to be in compliance with Section 504 requirements by <br /> developing a plan for compliance to be submitted to the Section 504 <br /> Coordinator as soon as possible but not later than by the close of <br /> : � escrow for this acquisition.
