S � <br /> The use of lead-based paint is prohibited on residential <br /> property. As such, this Project is required to test for lead-based <br /> paint under Federal law. Title X of the Housing and Community <br /> Development Act of 1992, which appears within Title 24 CFR Part 35 <br /> sets forth the requirements concerning lead-based paint in <br /> federally associated housing. To the extent applicable . and not <br /> otherwise exempt under federal law, the Developer shall cause a <br /> Lead-Based Paint Inspection and Risk Assessment to be conducted by <br /> an ADHS Certified Inspector, with random testing to include all <br /> painted surface components, dust wipe samples and soil samples . <br /> Stabilization and/or abatement shall be conducted by DHS certified <br /> contractors and qualified workers prescribed by law. <br /> 6. Environmental Review <br /> The City has conducted the necessary environmental review <br /> consistent with CEQA and NEPA regulations and will obtain the <br /> Release of Funds from HUD required to disburse the HOME Funds under <br /> this Agreement . The Developer must comply with mitigations <br /> required pursuant to any CEQA and NEPA review applicable to this , <br /> Project . The City will make said environmental reports available <br /> to the Developer at the time the Developer executes this Agreement . <br /> 7 . Plan and Specification Permits <br /> The Developer agrees that all plans and specifications <br /> required to be prepared for any and all construction of the Project <br /> ' shall be submitted both to the Agency and to the appropriate <br /> department of the City for approval prior to the commencement of <br /> the construction. Additionally, the Developer shall apply for and <br /> receive all approvals and/or permits required under Federal, State <br /> or City regulations as are necessary for the Project and/or as <br /> necessary for Developer' s intended use of the Property. <br /> 8 . Ouality/Workmanship <br /> All works of improvement must be constructed and finished <br /> in accordance with all applicable provisions of the Redwood City <br /> Municipal Code and the regulations and procedures of its various <br /> departments, and in a manner sufficient to obtain a Certificate of <br /> Completion and, to the extent applicable, a Certificate of <br /> ; , Completion. <br /> ' i <br /> ' The Project will be developed in a first class manner, <br /> � i constructed of quality materials, to City Code, and shall be <br /> ' unified in architectural theme and treatment throughout the <br /> Property and adjacent off-site areas, insofar as reasonable and <br /> practicable . <br /> REDW\0006\DOC\013-6 <br /> B - 2 3/08/OS mvc <br />
