<br />ARTICLE 6 <br /> <br />This Agreement is contingent upon the availability of funds appropriated by the Congress of <br />the United States and the availability of funds from the City for purposes of this Agreement. <br /> <br />ARTICLE 7 <br /> <br />Nothing in this Agreement shall prevent any other state, organization, or individual from <br />entering into separate agreements with WS for the purpose of controlling predatory <br />animals. <br /> <br />ARTICLE 8 <br /> <br />PurSUaJ.1t to Section 22, Title 41, United States Code, no member of or delegate to <br />Congress shall be admitted to aJ.1y share or part of this Agreement or to any benefit to arise <br />there from. <br /> <br />ARTICLE 9 <br /> <br />WS shall hold the City, its City Council, officers, agents aJ.1d employees harmless from aJ.1y <br />liability arising from the negligent act or omission of a Government of officer or employee <br />acting within the scope of his or her employment to the extent compensation is available <br />purSUaJ.1t to the Federal Tort Claims Act (FTCA), 28 USC 2671 et. seq., except to the <br />extent that aforesaid liability arises from the negligent act or omissions ofthe City, its <br />employees, agents, or subcontractor(s). Such relief shall be provided pursuant to the <br />procedures set forth in the FTCA. <br /> <br />ARTICLE 10 <br /> <br />No person in the United States shall, on the grounds of race, color, national origin, sex, age, <br />religion, or political beliefs, or disability, be excluded from participation in, be denied benefits of, <br />or be otherwise subject to discrimination under any program or activity for which the recipient <br />receives Federal finaJ.1ciai assistaJ.1ce. Not all prohibited bases apply to all programs. <br /> <br />ARTICLE 11 <br /> <br />This Agreement shall become effective when WS receives the signed Agreement in the WS <br />State Office in Sacramento, CA, aJ.1d shall continue indefinitely.
