Redwood City <br /> <br />This sublease is made and entered into this 30 +tclay of <br />~~I1A~ ' 19'Îf, by and between the City or <br />Redwood ci~ a munic~pal corporation of the State of California, <br />(hereinafter called "Sublessor"). and OMIX, Inc. (hereinafter <br />called "Sublessee"). <br /> <br />. This sublease is subjec~ to all the terms and conditions of <br />the lease agreement entered into by and between Sheila L. Ortloff <br />("Lessor") and the City of Redwood City (Sublessor herein), dated <br />September 9, 1993 (the "Master Lease"), a copy or which has, <br />prior to execu~ion of this sublease, been provided to Sublessee. <br /> <br />1. T,'F.A.SE PREMISES. In consideration of the covenants to <br />be kept and performed by Sublessee pursuant to this Sublease, <br />Sublessor hereby leases and rents to Sublessee and Sublessee does <br />hereby take, accept and hire from Sublessor, upon the terms and <br />conditions hereafter set forth those certain premises (the <br />"premises") outlined on the floor plan for the 5th floor, <br />consisting of 4068 square feet (more or less) of space, attached <br />hereto as Exhibit "All and by this reference made a part, in the <br />. building in the City of Redwood City, County of San Mateo, State <br />of California, commonly known as 702 Marshall Street (hereinafter <br />referred to as the "Building"). <br /> <br />Fe: . 2. TERMS. The term of this sublease shall commence on <br />1:£~~~ lJL, 1998, hereinafter referred to as the "Commencement <br />Date" (subject to postponement as hereafter provided). or on such <br />earlier date as Sublessee shall, with Sublessor's written <br />approval, occupy che Premises or any part Lhereof and shall end <br />on October 31, 1998, unless sooner terminated as herein provided. <br />Subject co delays beyond the reasonable concrol of Sublessor, <br />and! or by reason of action or inaction of Sublessee, Sublessor <br />shall endeavor to perform such alterations which may be required <br />and specified as being performed by Sublessor on Exhibit "8" <br />herein, if any, and ~o substantially complete such alterations by <br />the Commencement:. Date.
