<br />JAH:dft 101?6/93 (009/36) <br /> <br />2. <br /> <br />This Council has determined that the portion of Franklin <br /> <br />Street <br /> <br />and <br /> <br />the <br /> <br />storm water easement <br /> <br />and <br /> <br />the <br /> <br />sewer <br /> <br />and water <br /> <br />easement to be abandoned by this resolution, are not useful as a <br /> <br />nonmotorized transportation facility as that term is defined in <br /> <br />Section 156 of the Streets and Highways Code. <br /> <br />3. <br /> <br />This <br /> <br />Council hereby finds <br /> <br />tha t a <br /> <br />certain portion of <br /> <br />Franklin Street is unnecessary for present or prospective public <br /> <br />use and hereby orders that such portion of Franklin Street be <br /> <br />vacated, subject to the reservation of a public service easement <br /> <br />located therein. <br /> <br />The portion of Franklin Street so vacated and <br /> <br />the <br /> <br />public <br /> <br />service <br /> <br />easement <br /> <br />so <br /> <br />reserved <br /> <br />and <br /> <br />excepted <br /> <br />are <br /> <br />described and shown on Exhibits "A", "B" and "C" attached hereto <br /> <br />and incorporated herein by reference. <br /> <br />4 . <br /> <br />This Council hereby finds that the storm water easement <br /> <br />and <br /> <br />the <br /> <br />water <br /> <br />and <br /> <br />sewer <br /> <br />easement <br /> <br />hereinafter <br /> <br />described <br /> <br />are <br /> <br />unnecessary <br /> <br />for present <br /> <br />or prospective <br /> <br />pub lic use <br /> <br />and hereby <br /> <br />orders <br /> <br />that such easements be vacated. <br /> <br />The easements ordered <br /> <br />vacated by this resolution are described and shown on Exhibits <br /> <br />"A" and "B" attached hereto and incorporated herein by reference. <br /> <br />5 . <br /> <br />The City Clerk hereby is directed to record a certified <br /> <br />copy of this resolution and order, <br /> <br />attested by the City Clerk <br /> <br />under seal, in the office of the Recorder of the County of San <br /> <br />Mateo. <br /> <br />6. <br /> <br />From and after the date this resolution is recorded, the <br /> <br />portion of Franklin Street described in the final sentence of 3. <br /> <br />above no longer constitutes a public street, and the easements <br /> <br />2 <br /> <br />12097 <br />
