<br />DES:djk 1("11/93 <br /> <br />(002/37) <br /> <br />authority <br /> <br />to <br /> <br />SAMCAT <br /> <br />regarding <br /> <br />regulation <br /> <br />of <br /> <br />cable <br /> <br />television <br /> <br />rates within the City's jurisdiction; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />1. <br /> <br />This Council hereby authorizes SAMCAT to apply to the <br /> <br />FCC <br /> <br />for <br /> <br />certification <br /> <br />of <br /> <br />the <br /> <br />City <br /> <br />of <br /> <br />Redwood <br /> <br />City <br /> <br />for <br /> <br />the <br /> <br />regulation of cable television rates and to act on behalf of the <br /> <br />City <br /> <br />with <br /> <br />regard <br /> <br />to <br /> <br />reviewing, <br /> <br />analyzing <br /> <br />and <br /> <br />making <br /> <br />recommendations for said rate regulation; provided, that SAMCAT <br /> <br />shall act only on such issues in a manner consistent with FCC <br /> <br />procedures and regulations governing rate regulation proceedings; <br /> <br />provided, further, that SAMCAT shall, in carrying out its duties <br /> <br />and authority hereunder, provide the opportunity for hearing, and <br /> <br />shall consider, the views of all interested parties. <br /> <br />2. <br /> <br />This <br /> <br />Council <br /> <br />hereby <br /> <br />authorizes <br /> <br />and <br /> <br />directs <br /> <br />the <br /> <br />Executive Director and/or Chairperson of SAMCAT, <br /> <br />or his or her <br /> <br />designee, <br /> <br />to file necessary certification forms and such other <br /> <br />documents prescribed by the FCC; a copy of which <br /> <br />certification <br /> <br />form(s) shall be served on TCI Cablevision of California, Inc. by <br /> <br />first class mail on or before the date of filing thereof with the <br /> <br />FCC. <br /> <br />3. <br /> <br />This Council hereby retains the right and authority to <br /> <br />make decisions with regard to said rate regulation independently <br /> <br />from those made by SAMCAT, and shall be solely responsible for <br /> <br />acting <br /> <br />upon <br /> <br />recommendations <br /> <br />made <br /> <br />by <br /> <br />SAMCAT <br /> <br />pertaining <br /> <br />to <br /> <br />its <br /> <br />delegated authority hereunder. <br /> <br />2 <br /> <br />J208'8' <br />
