<br />AGREEMEN"{ <br /> <br />IDIS AGREEMENT is made as of this 29th day of June 1993, by and between the <br />City and County of San Francisco. a municipal corporation, hereinafter referred to as 'City,' <br />acting by and through its Water Department, and the City of Redwood City, hereinafter <br />referred to as "Suburban Agency." <br /> <br />RECITALS <br /> <br />WHEREAS, continuous monitoring of the residual disinfectant concentration in water <br />entering the distribution system is one of the filtration avoidance criteria required under <br />federal surface water treatment regulations; and <br /> <br />WHEREAS, the City and the Suburban Agency are each interested in meeting the <br />filtration avoidance criteria; and <br /> <br />WHEREAS, the City is wi11ing to perform certain monitoring activities which the <br />parties anticipate will satisfy the California Department of Health Services and the U.S. <br />Environmental Protection Agency as to this criterion, on the terms contained in this <br />Agreement; and <br /> <br />WHEREAS, the San Francisco Public Utilities Commission has authorized this <br />Agreement by its Resolution No. 93-0194, adopted June 29, 1993. <br /> <br />NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: <br /> <br />1. Monitorim~ Servic~. The City will continuously monitor the residual <br />disinfectant concentration at the Alameda East Portal, at Casey Quarry or an equivalent <br />location, and at Baden near the City boundary" Data collected from continuous monitoring <br />of the residual disinfectant concentration at these points will be submitted to the California <br />Department of Health Services as part of the monthly report prepared and submitted by the <br />Water Department When the turbidity level at Tesla Portal exceeds one (1) NTIJ, the City <br />will monitor for tota! coJifonn levels at Alameda East Porta] in the manner provided by Slate <br />regulation. <br /> <br />2. Comoensation. The costs of performing the monitoring and data collection <br />described in Section 1 shall be considered "wholesale system expenses - purification" and <br />shall be allocated between the City and the Suburban Purchasers, consistent with the <br />methodology established by the Settlement Agreement and Master Water Sales Contract, <br />dated May 25, 1984 ("Settlement Agreement"), to which the City and the Suburban Agency <br />are parties. <br /> <br />114456.1 <br /> <br />Exhibi t "A" <br />
