<br />3. Other Aereements Between the City and the Suburban Aleney. The City <br />~d the Suburban Agency agree that this Agreement shall in no way modify or alter the <br />Settlement Agreement. Both parties acknowledge that reference to the Settlement Agreement <br />is solely for the purpose of specifying how the costs of monitoring incurred by the City will <br />be allocated to the Suburban Purchasers and factored into wholesale water rates, which will <br />be the mechanism through which the Suburban Agency will pay its share of such costs. <br /> <br />4. Compliance with Laws and Re~lations. The parties agree that this <br />Agreement does not enlarge, diminish or otherwise change either of the parties respective <br />duties and responsibilities with respect to complying with local, state and federal laws, " <br />including, without limitation, laws concerning the distribution and treatment of water. <br /> <br />s. No Warranties. The City does not warrant the accuracy of the testing and <br />monitoring results and assumes no liability for the accuracy thereof. The Suburban Agency <br />waives any and all claims, actions and damages against the City regarding the accuracy of <br />testing and monitoring results obtained pursuant to this Agreement. <br /> <br />6. Tennination. Either party may terminate this Agreement by giving sixty (60) <br />days written notice to the other party if the California Department of Health Services notifies <br />either the City or the Suburban Agency that the disinfectant residual monitoring and coliform <br />analysis covered by this Agreement are no longer necessary for compliance with the f1ltration <br />avoidance criteria. In the event of such termination, the Suburban Agency shall pay the City <br />for the cost of monitoring services performed under this Agreement up to the effective date <br />of termination. <br /> <br />7. Notices to the Parties. All notices to be given by the parties shall be in <br />writing and served by depositing same in the United States Post Office, postage prepaid and <br />addressed as follows: <br /> <br />To City: <br /> <br />San Francisco Water Department <br />Division of Water Quality <br />1000 EI Camino Real <br />Millbrae, CA 94030 <br /> <br />To Suburban Agency: <br /> <br />City of Redwood City <br />P.
