The City shall reimburse <br /> <br />3 <br /> <br />4 <br /> <br />the Town one half (%) of the amount of bid for the Replacement Facilities portion of the <br /> <br />5 <br /> <br />Project within thirty (30) days after notice to the City of the award of the contract for the <br /> <br />6 <br /> <br />Project, to be held by the Town in a special account which shall bear interest for the <br /> <br />7 <br /> <br />benefit of City and used only for payments to the low bidder. <br /> <br />8 <br /> <br />5. The City agrees to reimburse the Town within thirty (30) days of completion of <br /> <br />9 <br /> <br />the Project the following: <br /> <br />10 <br /> <br />(a) The remaining one-half (%) of the bid cost for the Replacement Facilities <br /> <br />portion of the Project. <br /> <br />(b) Any change orders to the Replacement Facilities portion of the Project. <br /> <br />Any change order that exceeds $3,000 in cost or change orders which amount to $5,000 <br /> <br />15 <br /> <br />in aggregate shall require the prior approval of the City by its City Engineer in writing. The <br /> <br />16 <br /> <br />17 <br /> <br />City Engineer will act promptly to avoid delay claims. <br /> <br />18 <br /> <br />(c) The Town shall be solely responsible for all costs related to the Roadway <br /> <br />19 <br /> <br />Improvements as described in Exhibit A hereto. <br /> <br />(d) The Town shall be responsible for contract administration of the Project. <br /> <br />6. The City shall provide, in a timely manner, personnel who shall inspect and, if <br /> <br />constructed in accordance with plans and specifications, approve the Replacement <br /> <br />Facilities being installed. <br /> <br />7.
