<br />DES:djJc-12j_09/91 (128/28) <br />JRIGINAL <br />December 16, 1991 <br /> <br />RES 0 L U T <br /> <br />0 N <br /> <br />N O. <br /> <br />11656 <br /> <br />------- <br /> <br />RESOLUTION REQUESTING EX <br />AS "ANNEXATION OF THE <br />REDWOOD CITY" FROM THE <br />DISTRICT AND CONFIRMING <br />TREATMENT CAPACITY PERTA <br /> <br />LUSION OF TERRITORY DESIGNATED <br />ANDS OF HUNG TO THE CITY OF <br />OAK KNOLL SEWER MAINTENANCE <br />EALLOCATION OF SANITARY SEWAGE <br />NING THERETO <br /> <br />WHEREAS, <br /> <br />pursuant <br /> <br />to <br /> <br />that <br /> <br />certain <br /> <br />agreement <br /> <br />entitled <br /> <br />II Agreement between Oak Knoll Sewer Maintenance District and the <br /> <br />City of Redwood City for Se age Treatment and Disposal, II dated <br /> <br />March 18, 1958 (the "Services Agreement") by and between the City <br /> <br />("City") <br /> <br /> <br />provides <br /> <br />sanitary <br /> <br />sewerage <br /> <br />of Redwood City <br /> <br />the Oak Knoll Sewer Maintenance <br /> <br />District <br /> <br />("District") , <br /> <br />transmission and treatment <br /> <br />to District; and <br /> <br />WHEREAS, <br /> <br />pursuant <br /> <br />to <br /> <br />that <br /> <br />certain <br /> <br />agreement <br /> <br />entitled <br /> <br />"Agreement - Wastewater Tre tment Capacity <br /> <br />(Emerald Lake Hills <br /> <br />the <br /> <br /> <br />(the <br /> <br />"Capacity Agreement") <br /> <br />by and <br /> <br />Area)" <br /> <br />dated August 19, 1980 <br /> <br />between <br /> <br />City <br /> <br />and <br /> <br />of <br /> <br />San Mateo, <br /> <br />sanitary <br /> <br />sewerage <br /> <br />treatment capacity rights are allocated by City for certain areas <br /> <br />within County, including <br /> <br />within District's boundaries; and <br /> <br />WHEREAS, <br /> <br />pursuant <br /> <br />to <br /> <br />No. <br /> <br />I , bS5, <br /> <br />entitled <br /> <br />"Resolution Ordering <br /> <br />y Designated as 'Annexation of the <br /> <br />Lands of Hung to the <br /> <br />Redwood City', Annexed to the City <br /> <br />of Redwood City and detached <br /> <br />rom Oak Knoll Sewer Maintenance and <br /> <br />Emerald Lake Heights Highway Lighting Districts, Respectively", <br /> <br />adopted <br /> <br />December <br /> <br />16, <br /> <br />1991 <br /> <br />by <br /> <br />this <br /> <br />Council, <br /> <br />the <br /> <br />territory <br /> <br />described <br /> <br />in Exhibit <br /> <br />II A" <br /> <br />h reof, <br /> <br />attached hereto and by this <br /> <br />reference incorporated herein (the "Annexing Territory") has been <br /> <br />11656 <br />
