<br />DES:djJ<" 12/09/9l <br /> <br />(128/28) <br /> <br />ordered annexed to the City of Redwood City and detached from <br /> <br />District; and <br /> <br />WHEREAS, paragraph 8 of the Services Agreement provides that <br /> <br />when a portion of District's territory is annexed to the City, <br /> <br />said agreement becomes inapplicable to that portion upon receipt <br /> <br />by the governing board of District of a copy of a resolution <br /> <br />adopted by the City Council of City requesting exclusion of such <br /> <br />, <br />, ' <br /> <br />territory <br /> <br />from District as provided in Health and Safety Code <br /> <br />Section 4926; and <br /> <br />WHEREAS, paragraph 6 (b) <br /> <br />of the Capacity Agreement provides <br /> <br />that <br /> <br />when <br /> <br />territory <br /> <br />for <br /> <br />which <br /> <br />sanitary <br /> <br />sewerage <br /> <br />treatment <br /> <br />capaci ty is allocated under said agreement is annexed to City, <br /> <br />the <br /> <br />capacity <br /> <br />rights <br /> <br />allocated <br /> <br />to <br /> <br />the <br /> <br />County <br /> <br />of <br /> <br />San <br /> <br />Mateo <br /> <br />thereunder shall be reduced by the amount which is attributable <br /> <br />to the portion so annexed; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />1. <br /> <br />Pursuant to paragraph 8 of the Services Agreement and <br /> <br />Section 4926 of the Health and Safety Code, the governing body of <br /> <br />the Oak Knoll Sewer Maintenance District is hereby requested to <br /> <br />exclude the Annexing Territory from District. <br /> <br />2. <br /> <br />Pursuant to the provisions of paragraph <br /> <br />6(b) <br /> <br />of the <br /> <br />Capaci ty Agreement, <br /> <br />this Council hereby confirms that sanitary <br /> <br />sewerage treatment capacity rights for sewage emanating from the <br /> <br />Annexing Terri tory shall be furnished to said Terri tory in the <br /> <br />amount of one <br /> <br />(1) dwelling unit equivalent <br /> <br />(250 gallons per day <br /> <br />2 <br />
