<br />or damage to property and for injuries to or death of any person (including but not limited to <br /> <br />the property or employees of each party) when arising out of or resulting from (a) any act or <br /> <br />omission by City, itS agents, employees, contractors or subcontractors in connection with the <br /> <br />Project, and/or (b) City's breach of any representation warranty or covenant established in this <br /> <br />Agreement. City shall also fully release, indemnify, hold harmless and defend Indemnitees <br /> <br />from and against any and all claims or suits that may be brought by any contractor or <br /> <br />subcontractor performing work in connection with or related to the Project. City' s obligation <br /> <br />to defend shall include the payment of all attorney's fees and all other costs and expenses of <br /> <br />suit, and if any judgment is rendered against any Indemnitee, City shall, at its expense, satisfy <br /> <br />and discharge the same. <br /> <br />3.2 <br /> <br />Insurance. <br /> <br />(a) <br /> <br />Types of Insurance. <br /> <br />City shall require any contractor ("Contractor") providing services for <br /> <br />the Project to maintain in full force and effect, until completion and acceptance of the Project, <br /> <br />the following specific policies of insurance: <br /> <br />(1) <br /> <br />Worker's Compensation. <br /> <br />Worker's Compensation in accordance with the provisions of <br /> <br />Section 3700 of the California Labor Code (and any Amendments thereto or successor acts or <br /> <br />statutes) and the Contractor shall furnish Authority with a certificate evidencing such coverage <br /> <br />together with a verification thereon as follows: <br /> <br />"I am aware of the provisions of Section 3700 of the California <br />Code which requires every employer to be insured against a <br />liability for workers' compensation or to undertake self-insurance <br />in accordance with the provisions of that code, and I will comply <br /> <br />-6- <br /> <br />631214.2 <br />
