<br />REPORT <br /> <br />To the Honorable Mayor,and City Council <br />From the City Manager <br /> <br />January 10, 2000 <br /> <br />Subject <br />Redwood Shores Levee Fencing and Gates Contract <br />Engineering File No. 803-02 <br /> <br />Recommendation <br />Take appropriate action. <br /> <br />Background <br />On December 6, 1999, this Council adopted Resolution No. 13804, approving the <br />Contract Documents for the subject project, and authorized staff to advertise the project <br />for bid. Prior to voting on the Resolution, this Council heard input from members of the <br />public both supporting and opposing the project. <br /> <br />This project is being considered now, as the City received a 60-day formal Notice of <br />Intent to sue from the Sequoia Audubon Society stating that if the "exclusionary fencing <br />(i.e., gates)" is not installed, they will sue the City under the "Endangered Species Act" <br />The maximum penalty to the City of not following through with this "exclusionary <br />fencing" is $25,000 per offense per day. Representatives from the Society were <br />present at the December 6, 1999 meeting, and the Council had an opportunity to hear <br />from them directly. <br /> <br />After the Council meeting of December 6, 1999, the City Council appointed a <br />negotiation committee comprised of Mayor Ruskin, and Councilmembers Hartnett and <br />Jordan. They meet the week of December 13, 1999 and January 4, 2000, and as of the <br />drafting of this report, have scheduled a meeting with the Audubon Society for <br />Wednesday, January 5, 2000. The Sequoia Audubon Society has its Board meeting on <br />January 6, 2000. The outcome of these meetings will be presented orally at the <br />January 10, 2000 Council meeting. <br /> <br />-.....--.~, ~ <br /> <br />This project only covers the fencing and gates portion of the Levee Mitigation program. <br />If the Council approves this Award of Contract, five (5) chain link gates will be installed <br />at five different locations, along with approximately 3200 feet of fencing. As a result of <br />this installation, the public will not be able to access approximately 1.9 miles of levee <br />facing San Francisco Bay. A map of the location of these fences and gates is attached. <br /> <br />.- r <br />
