<br />'5 A- I <br /> <br />REBaR <br /> <br /> <br />ayor an ity Council <br />From the City Manager <br /> <br />January 24, 2000 <br /> <br />Subject <br />Zoning Text Amendment Regarding Music Studios in the Neighborhood Commercial ("CN") <br />Zoning District <br /> <br />Recommendation <br />1) Approve the Zoning Text Amendmentto Require Use Permits for Music Studios in the <br />"CN" Zoning District. <br />2) Initiate a Zoning Text Amendment to Require Use Permits for Music Studios in the "CG" <br />Zoning District. <br /> <br />Background <br />Several months ago a Council Subcommittee reviewed code enforcement issues, including <br />some issues involving the Zoning Ordinance. The subcommittee was made up of Council- <br />members Diane Howard, Jeff Ira, and former Councilmember Leipzig. <br /> <br />The Subcommittee has recommended a change so as to permit music studios' with a <br />Conditional Use Permit in the Neighborhood Commercial ("CN") Zoning District. <br /> <br />The City currently allows music studios outright in the "CN" Zoning District without any <br />public notification or hearing2. These commercial areas normally adjoin residential areas, <br />and music studios could easily pose noise impacts on adjoining residences. <br /> <br />Examples of "CN" zoned areas include the Canyon Road Shopping Center (at the <br />intersection of Canyon and Oak Knoll) and the Roosevelt Shopping Center (at the <br />intersection of Roosevelt and Upton) <br /> <br />For this reason, the Subcommittee is recommending that music studios be permitted with <br />a Conditional Use Permit. The Conditional Use Permit process would require staff to notify <br />adjoining residences within 300 ft. of the use and schedule a public hearing. The Zoning <br />Administrator could then approve, approve with conditions, or deny the request. <br /> <br />1 A music studio is a place where audio recordings are made and/or musicians practice their instruments <br />or musical instruction occurs. It does not include stores whose primary function is the retail sales of <br />musical instruments <br />2 Music studios are also permitted outright in another commercial zone, CBR (Central Business Retail), if <br />on the second floor or above. Music studios in this district should not cause nuisances given the CBR's <br />distance to housing and other commercial uses in the area. Also music studios require a Use Permit in <br />the Industrial Park ("IP") and Professional Office ("PO") Zoning Districts. Music studios are not specifiçally <br />allowed in any other zoning district, unless as determined by the Zoning Administrator. .;0 " <br /> <br />~.,-,. ..'-'f <br />
