<br />iA1, <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />January 14, 2000 <br /> <br />Subject <br />Zoning Text Amendment Relating to Large Family Day Care Homes <br /> <br />Recommendation <br />Modify the Recommendation of the Planning Commission Regarding Large Family Day <br />Care Homes <br /> <br />Background <br />A Council Subcommittee 1 and staff have been reviewing code enforcement issues over the <br />last year, including some issues involving the Zoning Ordinance. The Subcommittee and <br />the Planning Commission are both recommending a change so as to require notification <br />of adjoining properties for proposed "large family day care homes"2. <br /> <br />The City currently allows large family day care homes in residential areas subject to <br />obtaining a non-discretionary permit. A non-discretionary permit is a permit that is simply <br />issued over the counter as long as the applicant agrees to meet certain conditions. Please <br />refer to the attached copy of Section 2.21.1 of the Zoning Ordinance and the Non- <br />Discretionary Permit Application. <br /> <br />The standard conditions of approval of the non-discretionary permit include fulfilling certain <br />parking requirements and State safety laws, and operating the business such that it will <br />"not adversely affect adjoining residences and not be detrimental to the health, safety, and <br />welfare of the neighborhood." <br /> <br />The non-discretionary permit process for large family day care homes was established by <br />City Council in 1991, in order to facilitate and promote childcare in Redwood City. The City <br />established this simple process with the intent of increasing childcare opportunities in <br />Redwood City. This streamlined process emerged from conversations with the Redwood <br />City Child Care Coordinator and other interested child care agencies. Under the current <br />ordinance, no public hearings are required for this permit. <br /> <br />According to current State law, a city can regulate large family day care homes in three <br />alternative ways. The Redwood City Zoning ordinance incorrectly defines it as <br />only 7 - 12 children due to the fact that State Law changed since the last ordinance revision.
