<br />ATTACHMENT # 2. <br /> <br />PLANNING COMMISSION MINUTES DATED 7/20/99 <br />PLANNING COMMISSION EXCERPTS <br />9/20/99 <br /> <br /><tAl <br /> <br />Proposal to amend Section 2.21-c-2 of the Redwood City Zoning <br />Ordinance regarding notice and process requirements for Large Family <br />Day Care Homes. <br /> <br />Proposed Action: Hold public hearing and make recommendation to City <br />Council. <br /> <br />Chairman Verdone asked Mr. Passanisi who were the nine persons that <br />received the notices. Mr. Passanisi said that, at the suggestion of the <br />City's Child Care Coordinator, staff had contacted various child care <br />organizations in the County and had put a notice in the paper. Mr. <br />Passanisi said that in the last six months a sub-committee of the City <br />Council1 has been meeting and had recommended changes to this section <br />of the Zoning Ordinance. He said that currently the City requires what <br />they called a non-discretionary permit to obtain for large family day care <br />homes. This was done deliberately, to make the process of establishing <br />such a child care facility as straightforward as possible. Non- <br />discretionary permits are issued over the counter and approved as long as <br />the applicant meets certain conditions. <br /> <br />Mr. Passanisi said that the Council sub-committee is recommending that <br />staff notify the surrounding neighbors of proposed. new large family day <br />care homes, and that the Zoning Administrator hold a public hearing if <br />there is opposition or when requested, in response to the notice. The <br />Zoning Administrator must approve the project if it complies with the <br />standards of traffic control, parking, spacing, concentration, noise, and fire <br />requirements. <br /> <br />Mr. Passanisi said that state law specifies that cities can only notify people <br />within 100 feet of the proposed large family day care homes, as opposed <br />to the City's normal practice of noticing out 300 feet. When questioned, <br />the City Attorney clarified that the City could not be more restrictive than <br />the State legislation. In this case, it meant that the City was bound to the <br />one hundred foot notice limit. <br /> <br />The sub-committee is also asking the Planning Commission to consider <br />the possibility of spacing requirements. Mr. Passanisi said that some <br />cities do require some distance between large family day care homes, on <br />the premise that too many in anyone neighborhood could lead to <br />impaction problems. Mr. Passanisi showed a slide of the locations of large <br />family day care homes and indicated that applications under the proposed <br />new procedures will take three to four weeks to process and the fee is <br />proposed to be $100.00. <br /> <br />1 Consisting of the Mayor and counciJ members Ira and Leipzig. <br /> <br />.._~"._.'."..'..-'.T'... <br />
