5(1.,

REPORT

To the Honorable Mayor and City Council
From the City Manager

March 27,2000

Subject
Status of Levee Closure

Recommendation
Levee Subcommittee action (see below).

Background
The City made a good faith proposal to the U. S. Fish and Wildlife Services (U.S.F.W.)
to close the levees at night and keep them open during the day. As of the permit
deadline, February 28th the City had not received the response from U.S.F.W. On
Thursday, March 2, the City began implementing its proposal and has been operating
under that proposal up to the present.

On March 15, the City received a formal copy of a letter (see attached) from U.S.F.W. to
the Corps of Engineers, rejecting the City's proposal.

The Levee Subcommittee met for two hours on Thursday March 16th to discuss this latest
development. After considerable discussion, a majority of the Subcommittee
recommends the following actions: 1) the City close the gates immediately, 2) the City
continue to seek extension of the levee permit, 3) The City develop a revised proposal for
the U.S.F.W.

y~~

Ira Ruskin
Chair

'.'T...~
