<br />Ò &-2- <br /> <br />RESOLUTION NO. <br /> <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION <br />OF AGREEMENT GRANTING ENCROACHMENT AGREEMENT <br />FOR THE INSTALLATION OF FIBER OPTIC NETWORK <br />FACILITIES WITHIN THE PUBLIC RIGHT-OF-WAY <br /> <br />(WilLIAMS COMMUNICATIONS, INC.) <br /> <br />WHEREAS, Williams Communications, Inc., dba VYVX, Inc., a Delaware <br /> <br />Corporation ("Williams"), wishes to install and maintain fiber optic network <br /> <br />facilities within the public right of way within the limits of the City of Redwood <br /> <br />City; and <br /> <br />WHEREAS, under California law, the City of Redwood City may regulate <br /> <br />the "location and the manner of construction, installation, and maintenance of <br /> <br />network facilities in the public right-of-way within the limits of the City of Redwood <br /> <br />City; . <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCil OF THE CITY OF REDWOOD <br /> <br />CITY, as follows: <br /> <br />That certain permit agreement entitled "Encroachment Agreement <br /> <br />between the City of Redwood City and Williams Communications, Inc., dba <br /> <br />VYVX, Inc., for the Construction, Installation, and Maintenance of Fiber Optic <br /> <br />Network Facilities Cables and Related Facilities Within the Public Right-of-way", <br /> <br />by and between the City of Redwood City, a municipal corporation of the State of <br /> <br />California and Williams granting authorization to Williams to install, maintain, and <br /> <br />Res0-850 <br />F:shlrwclcouncillreso <br />FXS:djk <br />03123/00 <br /> <br />1 <br />
