- 8�-2 <br /> � April 12, 2000 <br /> HIStO�/ <br /> The City was grarited control over the waterways beginning in 1945 (Exhibit D). <br /> In the 1960's, the property owner, J. Franklin Salaman, canvince�d the City <br /> Council to lease him the water for a marina. The business interest is later <br /> conveyed to other parties. Fred Eamhardt, Jr. inherited the business in 1986. <br /> Gradually, a residential use has developed as more people permanently live <br /> aboard their boats, house boats and floating homes. Floating homes are <br /> actually built in the marina and are currently being built at an accelerated rate <br /> (Exhibit E). All of this development has been done without permits or <br /> approvals. The infrastructuce does not exist at this time to support the <br /> residential use (There are no legal sewer connections. The water supply is <br /> undersized, etc.) There are not proper facilities on shore to support the <br /> community. Multiple violations exist which may include violations of the Clean <br /> Water Act and other federal and state laws, along with City ordinances (Exhibit <br /> �• <br /> The City has been aware of the situation for a number of years. The marina is <br /> in a state of disrepair. Code Enforcement has been attempting to compel Mr. <br /> Eamhardt to get permits and make repairs (Exhibit G). � <br /> Recommendations <br /> I have met with City staff on April 6, 2000 and directed Code Enforcement to <br /> enforce any issues conceming health and safety. I recommend that the <br /> . Council direct the City Attomey to issue a Cease and Desist order to curtail any <br /> further.development in violation of the Redwood City code, applicable state <br /> law, and the terms and conditions of the permit. I further recommend that we <br /> ' address the issue through a comprehensive ordinance dealing with live aboard <br /> vessels, floating homes and marinas throughout the City. <br /> 2 <br />
