<br />c:, LS- \ ~ <br /> <br />commissions, officers, employees, and agents which may be brought against, or <br /> <br />suffered or sustained by Consultant, its directors, officers, employees, and <br /> <br />shareholders in the performance of any services or work related to the Project <br /> <br />including, without limitation, any claim made by any person or entity against <br /> <br />Consultant that the Official Statement pertaining to the issuance of bonds or <br /> <br />other evidence of indebtedness contains an untrue statement of a material fact <br /> <br />or omits to state a material fact required to be stated therein or necessary to <br /> <br />make the statements therein, in light of the circumstances under which they were <br /> <br />made, not misleading. <br /> <br />12. INSURANCE. Consultant shall acquire and maintain Workers' <br /> <br />Compensation, employer's liability, commercial general liability, owned and non- <br /> <br />owned and hired automobile liability, and professional liability insurance <br /> <br />coverage relating to Consultant's services to be performed hereunder covering <br /> <br />Agency's risks in form subject to the approval of the Agency Attorney.
