Box 6097 <br />San Mateo, California 94403 <br /> <br />Dear Reverend Owens: <br /> <br />This letter constitutes a revised use permit (the "Temporary Use Permit") for a <br />proposed church at 1406 Radio Road, Redwood City, California. This Temporary Use Permit <br />includes provisions agreed upon among interested parties to an appeal by the Redwood <br />Shores Owners Association ("RSOA") to the issuance of the use permit as originally granted <br />to the Fully Alive Community Church ("Church"). The conditions reflecting the agreement <br />conform to Exhibit £ of a Memorandum of Understanding dated :JüN~ Co, ~ooo ("MOU"), <br />executed by the Church, the South Bayside System Authority ("SBSA"), and RSOA. The City <br />is not a party to the agreement. <br /> <br />FindinQs: <br /> <br />1) On January 1, 2000, the Zoning Administrator held a public hearing on the application of <br />the Church to operate a church within a building located at 1406 Radio Road, Redwood <br />City, California (the "Property"). The Property is located in the RSB (Redwood Shores <br />Bayfront) Zoning District (Ord. No. 1130, as amended ["Zon. Ord."], § 28.1, et seq.). <br />Churches are conditionally permitted uses in the RSB Zoning District, Le., they are <br />permitted subject to the issuance of a use permit (Zon. Ord. § 28.4(e». <br /> <br />Members of the public testified at the Zoning Administrator's hearing that there is a need <br />and desire for a church in the Redwood Shores area of the City, within which the Property <br />is located. There are currently no other church sites in Redwood Shores. Some weekend <br />religious activities are held at Sandpiper Community Center. RSOA contended that, due <br />to the RSB zoning requirements, a use permit could not be issued to the Church until a <br />Specific Plan had been prepared for the Property and all other properties zoned RSB. <br />Based on the testimony and related facts of the proposal, the Zoning Administrator <br />approved the Use Permit application as indicated in the Use Permit letter dated January <br />26, 2000. <br /> <br />2) RSOA appealed the issuance of the Use Permit contending, as it had at the Zoning <br />Administrator's hearing, that under Zoning Ordinance Section 28.5, a Specific Plan must <br /> <br />Fullyalive-rsoa <br />f/sh/sh/RC/ComDev <br />M/ð 1/00 <br />1017 Middlefield Road <br /> <br />Redwood City, California 94063 <br /> <br />(650) 780-7234 <br /> <br />FAX 780-0128 <br />
