Zone Ord. <br />Section 28.5 provides, in pertinent part: <br /> <br />"Prior to any development within the RSB District, a Specific Plan shall be <br />prepared as set forth under California law (Gov. Code § 65451) to provide a <br />greater level of specificity in the planning of sites and also to show the scale and <br />relationships of the uses and/or structures. ..." <br /> <br />RSOA contended that use of an existing building as a church constituted a "development" <br />requiring preparation of a Specific Plan under said Section 28.5. The Zoning <br />administrator and the Church contended that use of an existing building with minor <br />improvements to a parking lot, removal of small existing structures and relocation of a <br />trailer to obscure it from public view, did not constitute a "development" requiring <br />preparation of a Specific Plan. <br /> <br />3) On March 13, the Council of the City of Redwood City heard the appeal. Having heard all <br />interested parties wishing to testify at the hearing, the Council closed the public hearing. <br />Following further discussions with representatives of the Church and RSOA, the Council <br />continued the matter for sixty (60) days to provide opportunity for the RSOA and the <br />Church to explore the possibility of reaching a compromise. <br /> <br />During the intervening period, representatives of the Church, RSOA, and SBSA met and <br />conferred regarding matters of mutual interest pertaining to future development and land <br />uses in the RSB Zoning District. As a result of those meetings, the Church, RSOA, and <br />SBSA entered the MOU which, among other matters, includes a compromise between <br />RSOA and the Church regarding the above-mentioned appeal. At the request of those <br />parties, this revised Use Permit includes provisions agreed upon among them. <br />Accordingly, the issue on appeal, viz., whether a Specific Plan would be required for the <br />use proposed by the Church was not determined. <br /> <br />4) By letter dated ..ÃJ,..,~ 7. , 2000, RSOA advised the City Council that it would <br />withdraw its appeal upon the issuance of a revised use permit for the Church's use of the <br />Property in the exact form as attached to that letter. This Temporary Use Permit is <br />identical to the form included with RSOA's JvNe..'-¡ , 2000 letter and, therefore, <br />RSOA's appeal is deemed withdrawn. On JVAI~ 1.;2. ,2000, the City Council, by <br />motion duly made and carried, terminated the appeal proceedings. <br /> <br />Permission is hereby granted to the Church to conduct and operate a church facility on the <br />Property subject to the following conditions: <br /> <br />Conditions <br /> <br />1. The Church, or its designee, shall prepare a Specific Plan showing all existing and <br />proposed new development as outlined in the MOU ("MOU Specific Plan"). In the event a <br />Specific Plan is not prepared, this Temporary Use Permit shall expire and terminate as <br />provided in Condition 22, below.
