<br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />June 26, 2000 <br /> <br />Subject <br />Deed Restriction Removal - Portion of Lots 3 and 4, Block 1, Homestead Addition, <br />Redwood Avenue - Engineering File No. 801-05 <br /> <br />Recommendation <br />Adopt a resolution approving the removal of deed restriction that prohibits construction <br />of any kind on portions of Lots 3 and 4, Block 1, Homestead Addition, without the <br />express permission of the Council of Redwood City, which restriction was recorded in <br />Deed in Volume 2911, Page 318 on November 9,1955, Records of San Mateo County. <br /> <br />Background <br />On August 15, 1955, by Resolution No. 1913, the City Council authorized the sale of a <br />portion of Lots 3 and 4, Block 1, Homestead Addition to Frank F. Giannini and Francis <br />F. Giannini. These lots are located on the south side of Redwood Avenue between <br />Gordon Street and Regent Street, and they are adjacent to the backyards of 1311 and <br />1315 Gordon Street, a duplex, which was also owned by the Gianninis. The City sold <br />the southerly 93':t portion of the lots to the Gianninis, seemingly with the intention that <br />this area will enlarge the backyard of the duplexes. The City retained the front 30' <br />portion of the lots to provide space for construction of the Redwood Creek Channel. <br />Because this portion of the lot did not have any street frontage, a deed restriction was <br />placed on it prohibiting it from becoming a buildable parcel. <br /> <br />In 1974, subsequent to the construction of the Redwood Creek Channel, the City sold <br />to the Gianninis the front 30' portion of Lots 3 and 4, except a triangular portion, which <br />is occupied by the concrete channel. This sale enabled the Gianninis to have legal and <br />physical access from Redwood Avenue to the southerly portion of Lots 3 and 4, which <br />they purchased from the City in 1955. This second piece of property sold to the <br />Gianninis did not have any deed restriction. <br /> <br />Now, the successors in interest and title to the property (the granddaughters of the <br />Gianninis) are asking the City to remove the restriction imposed on the property in <br />1955. <br /> <br />The City has no interest to retain this restriction any longer, therefore, staff <br />recommends to grant the request of the present owners. <br /> <br />,~,...-.
