<br />'IT-l. <br /> <br />Issues <br />. The removal of the deed restriction will allow this property to be used for a single <br />family dwelling. The lot size exceeds the minimum lot size for a single family <br />dwelling in the R-2 (Residential Duplex) District, and it has legal street frontage. <br /> <br />. After looking at some historical records, we can find no reason for restricting the use <br />of the parcel sold in 1955, except that it did not have frontage. The subsequent sale <br />in 1974 should have triggered the release of this restriction, because it provided <br />legal frontage for this lot. The city was able to sell this second piece of property to <br />the Gianninis because the formerly open creek had been put into a concrete <br />channel that took less space. <br /> <br />Fiscal Impacts <br />There will be no fiscal impact generated by the removal of the deed restriction. <br /> <br />~ú,~ <br />./' Lowell L.
