'IT-l.

Issues
. The removal of the deed restriction will allow this property to be used for a single
family dwelling. The lot size exceeds the minimum lot size for a single family
dwelling in the R-2 (Residential Duplex) District, and it has legal street frontage.

. After looking at some historical records, we can find no reason for restricting the use
of the parcel sold in 1955, except that it did not have frontage. The subsequent sale
in 1974 should have triggered the release of this restriction, because it provided
legal frontage for this lot. The city was able to sell this second piece of property to
the Gianninis because the formerly open creek had been put into a concrete
channel that took less space.

Fiscal Impacts
There will be no fiscal impact generated by the removal of the deed restriction.

~ú,~
./' Lowell L.
