<br />"1 D-Lthanoe Order No.2 will account for the numerous existing underground damage <br />caused by previous street work. The project anticipated using some existing <br />interconnect wires that had been installed in the past. However, much damage <br />was discovered during construction, rendering some of these connections useless. <br />These damages are not readily detected if the wires are not in use, and it is not <br />cost effective to pursue damages from contractors after-the-fact. <br /> <br />Because this is a Federally funded project, performance specifications had to be written <br />for competitive bidding. This is not the best way to purchase hardware and software. <br />Staff attempted to separate the computer portion out and administer it as a professional <br />contract, but this effort failed to get approval from Caltrans, who administered this fund. <br />The specifications also had to be written loose enough to attract enough bidders. <br /> <br />The design consultant and staff have determined that the software that the Contractor <br />proposed one year ago meets the specification, but is not what will benefit the City in <br />the long run. This software is based on old technology and will be outdated in a few <br />years. This solution will only work with equipment from one manufacturer. For these <br />reasons, it is recommended that the Council authorize the execution of Change Order <br />No.1 to allow the installation of equipment and software that will function for the City <br />on a long term basis, and will allow for future flexibility of using equipment from multiple <br />vendors. <br /> <br />A complete copy of the Change Orders and original Contract Documents are available <br />for review in the Engineering and Construction office. <br /> <br />Fiscal Impact <br />Funds for Change Order No 1 will initially be funded from the Transportation Grants <br />account in the 1998-99 Capital Improvement Project (CIP) budget. This CIP account <br />will be reimbursed from RTSOP grant. Funding for Change Order No.2 is allocated <br />under the Gas Tax Construction Fund the CIP. <br /> <br />~\~ <br /> <br />, S.
