"1 D-Lthanoe Order No.2 will account for the numerous existing underground damage caused by previous street work. The project anticipated using some existing interconnect wires that had been installed in the past. However, much damage was discovered during construction, rendering some of these connections useless. These damages are not readily detected if the wires are not in use, and it is not cost effective to pursue damages from contractors after-the-fact. Because this is a Federally funded project, performance specifications had to be written for competitive bidding. This is not the best way to purchase hardware and software. Staff attempted to separate the computer portion out and administer it as a professional contract, but this effort failed to get approval from Caltrans, who administered this fund. The specifications also had to be written loose enough to attract enough bidders. The design consultant and staff have determined that the software that the Contractor proposed one year ago meets the specification, but is not what will benefit the City in the long run. This software is based on old technology and will be outdated in a few years. This solution will only work with equipment from one manufacturer. For these reasons, it is recommended that the Council authorize the execution of Change Order No.1 to allow the installation of equipment and software that will function for the City on a long term basis, and will allow for future flexibility of using equipment from multiple vendors. A complete copy of the Change Orders and original Contract Documents are available for review in the Engineering and Construction office. Fiscal Impact Funds for Change Order No 1 will initially be funded from the Transportation Grants account in the 1998-99 Capital Improvement Project (CIP) budget. This CIP account will be reimbursed from RTSOP grant. Funding for Change Order No.2 is allocated under the Gas Tax Construction Fund the CIP. ~\~ , S.
