IbA-.
➢"RCN shall install active electronic devices (nodes, power supplies, and
amplifiers) in locations that minimize their appearance. This equipment may
be placed adjacent to existing equipment, behind existing landscaping, or
screened in some other way."
"RCN above-ground equipment shall be painted dark green."
➢"No earlier than five (5) years from this date, RCN shall retrofit above-ground
enclosures to flush amount at such time as the equipment and methodology
has been proven by RCN's use in areas similar to Redwood City. This would
allow Redwood City to require placing other equipment in vaults if the
technology progresses to that point."
"Trenching in streets will be repaved in ten days."
There was also concern over damage to private facilities, including landscaping and
paving. The standard agreement normally approved by the City has provisions for
replacing or fixing damaged facilities. The agreement states in part:
"... shall repair, replace, and restore in kind any such damaged
facilities at its sole expense..."
The Agreement also requires that RCN be responsible for "premature deterioration" of
pavement surfaces for a period of two years. Identified repairs must be completed in 90
days.
As part of this project, Redwood City will have an inspector who will be reviewing all
construction activities on public and private property.
In addition to the agreements that have been included in the Encroachment Agreement,
there were several other agreements reached, but not included in the Encroachment
Agreement because they are primarily agreements reached with homeowner
representatives and RCN, with City staff supporting those agreements. These
"informal" agreements are as follows:
:= Due to the type of system to be installed, it is understood that there will be
more above-ground equipment than the AT&T (formerly TCI) installation. It is
estimated tMat there will be approximately 40-50 power supplies and nodes
throughout Redwood Shores, most of which will be located in public right-of-
way.
Some residents did not want the RCN installation to have more equipment
than the AT&T cable system. It was understood that the RCN system
provides more services, and will require more equipment to provide that level
of service.
In multifamily projects, as much equipment as is feasibly possible shall be
placed in utility closets.
Plans for above-ground electronic devices shall be submitted to the
appropriate association for review and approval (RSHA, RSOA, & SBCA
(Shores Business Center Association). Approved plans shall be forwarded to
the City.
-2-
