�CaA•ti 3 <br /> The private associations have their own review process, and the City is not a <br /> participant in these reviews. RCN has agreed to go through the review <br /> process, and the City staff has agreed that processing of the construction <br /> plans will be done after approval by the appropriate association. <br /> ➢ Mitigation measures for above-ground equipment can include clustering with <br /> existing equipment, placing it behind existing landscaping, or adding new <br /> landscaping. <br /> This, in some respects, was the most difficult item to agree upon. <br /> Homeowners asked for the design of the system to see how the equipment <br /> would be dealt with in a typical neighborhood. RCN was reluctant to design <br /> the system when they had no approvals, and it is very costly to design these <br /> improvements. <br /> It was agreed that RCN would submit plans to the associations after approval <br /> of the agreements by the City Council. RCN's position was that they would <br /> be coming in as competitors to AT&T, and they would want to keep as many <br /> people as possible happy about their installation. If the Redwood Shores <br /> neighborhood was upset with appearance and construction problems, that <br /> would not be good business for RCN. <br /> It was also understood that there was not a universal solution for locating and <br /> screening the equipment, and each site will have to be looked at one-by-one. <br /> � RCN shall obtain permission from each of the "junior" associations for <br /> installation of improvements that are not covered under current recorded <br /> easements. <br /> The City has easements within the private streets for utilities, but depending <br /> upon the location of equipment within each subdivision, additional approval <br /> may be required. The "junior association" will also need to specify the type of <br /> passive connector (vault or pedestal) for the subdivision. <br /> The attached letter from RCN verifies that RCN will abide by this Agreement. <br /> Fiscal Impacts <br /> There are no fiscal impacts to Redwood City. RCN will pay 100% of plan checking and <br /> inspection costs.
