<br />9B~ <br /> <br />presence, conflicts can be an unhappy outcome of residential above or near retail, <br />restaurant and entertainment uses. <br /> <br />Additionally, the CBR district allows the most permissive buildout (a floor area ratio of <br />400% to 1000%), and like the CA zone, the Work Force Housing Production Ordinance <br />could be a disincentive to office in the Central Business District (above the ground <br />floor). <br /> <br />Lastly, the construction of housing in this district could compete. with other <br />redevelopment objectives and/or become a financial burden on a redevelopment <br />project or the Redevelopment Agency. <br /> <br />Excluding a Work Force Housing Production Ordinance from some commercial districts <br />on the basis of promoting other policy objectives has been successfully tested in the <br />courts. It is recommended that the Downtown Task Force address appropriate location <br />for residential use in the downtown. <br /> <br />4. Affordabilitv <br />Specific recommendations for affordability requirements are best included in a thorough <br />study of the housing demand created by office (a nexus study). Should the City Council <br />choose to adopt the Interim Urgency Ordinance, it would be referred to the Planning <br />Commission for further study. Staff would also take the issue to the Housing and Human <br />Concerns Committee. <br /> <br />The proposed Work Force Housing Production Ordinance encourages affordability by <br />virtue of the small unit size. In the case of in lieu fees, local models for the use of trust <br />fund money for housing purposes indicate fees are generally exclusively used for <br />affordable housing units and programs. <br /> <br />Alternatives <br />A. Pass or Modify the proposed Interim Urgency Ordinance: <br /> <br />1. EstabJish the housing mitigation requirement at 22% of the housing demand <br />created by the average number of employees generated by the average office <br />development. 22% would translate to: <br />1 dwelling unit/2000 s.f. office and $56,320 per equivalent dwelling unit <br />required in the case of in lieu fee. RECOMMENDED <br /> <br />2. Establish the housing mitigation requirement at less than 22% of the housing <br />demand and reduce the in lieu fee proportionately to one of the following: <br />20% mitigation would translate to: <br />1 dwelling unit/2500 s.f. office and $51,200 per equivalent dwelling unit <br />required in the case of in lieu fee. <br />15% mitigation would translate to: <br />1 dwelling unit/3300 s.f. office and $38,400 per equivalent dwelling unit <br />required in the case of in lieu fee. <br /> <br />6 <br />
