<br />9C¡ <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />August28,2000 <br /> <br />Subject <br />REPORT 3 - Bair Island Road Study Area <br />Interim Urgency Ordinance to enact a moratorium on all development in the Bair Island Study <br />Area, and include an exception for development agreements. Develop a specific plan for <br />this, and an adjacent area not subject to the moratorium. <br /> <br />Recommendation <br />1. Introduce an Interim Urgency Ordinance imposing a moratorium on all development, with <br />an exception for development agreements, in the Bair Island Study Area as shown on <br />Exhibit A to the ordinance. (This does not include areas zoned residential.) <br />2. Direct staff to include additional parcels in the Bair Island Specific Plan not subject to the <br />moratorium. <br /> <br />Background <br />On July 24, 2000, the City Council introduced (and on August 14, 2000 adopted) an Interim <br />Urgency Ordinance placing a pause on development for a period of 45 days on all <br />development in the Bair Island Study Area. In so doing, the City Council directed ,staff to: <br /> <br />1. provide additional detail including a schedule for preparation of a Specific Plan for the <br />Bair Island Road area, <br />2. consider an exemption to the Bair Island Study Area Interim Urgency Ordinance in <br />cases where the developer enters into a development agreement with the City, <br />3. move forward expeditiously with appropriate resources (staffing and consultants), and <br />4. schedule a joint study session with the Planning Commission, Housing and Human <br />Concerns Comm~ttee and the Architectural Review Committee. <br /> <br />Issues <br />1. Urqency Interim Ordinance <br />The Urgency Interim Ordinance (Attachment 1) proposed for adoption would exclude <br />projects subject to Development Agreement from the moratorium (see Attachment 2 for <br />further detail regarding Development Agreements). Projects which could proceed are <br />tenant improvements for existing uses and projects for which permits have been issued <br />prior to adoption of the ordinance. Otherwise, the ordinance enacts a prohibition on all <br />development in the Bair Island Road study area except areas zoned residential. <br /> <br />Under the regulation no building permits, use permits, architectural permits, planned <br />development permits, zoning variances, zoning permits, subdivisions, or any other land <br />use entitlements will be issued or approved with respect to properties within the Study <br />Area. Tenant improvements, in existing buildings will be allowed as long as the use <br />doesn't change. The existing Urgency Interim Ordinance will lapse. <br /> <br />""......._- _.~. <br />
