-1O Attachment 3 <br /> REPOR T � <br /> � <br /> � <br /> , <br /> � To the Honorabls Mayor and City Council � <br /> From the City Manager <br /> � EXECUTIVE SUMMARY <br /> June 12, 2000 <br /> Subject <br /> Accessory Dweliing Unit Ordinance <br /> Recommendation <br /> Review and discuss alternative regulations governing accessory dwelling units. Direct <br /> staff to prepare Resolution Initiating Proceedings to Amend the Zoning Ordinance to <br /> �� correspond to Council's determination. <br /> Staff recommends the following changes to the Accessory Dwelling Unit Ordinance: <br /> • Require the property owner to live on the property, either in the main or second <br /> unit. <br /> • Provide for an exception for undue hardship to be granted for a limited term by <br /> the Zoning Administrator with regard to owner occupancy. <br /> • Allow the unit size to be 640 sq. ft., 750 sq. ft., or 850 sq. ft. depending on lot <br /> size. <br /> • Establish a non-discretionary permit process with public notification of the <br /> accessory unit's approval. <br /> • Require one additional parking space for the second unit. The parking may be in <br /> the required 20-ft. front yard garage setback, uncovered, and can be tandem on <br /> the driveway apron. <br /> • Require the existing garage to remain available for vehicle parking. <br /> • Propose a 1-year amnesty period for existing illegal units to provide property <br /> owners an opportunity to legalize the units under these provisions and bring their <br /> units up to health and safety codes. During the amnesty program, the City will <br /> waive any inspection fees and fines. <br /> Issues <br /> The City has been reviewing its Accessory Dwelling Unit Ordinance for the last several <br /> years. Some of the issues that have been discussed include: small unit size, difficulty in <br /> meeting the parking requirements on site, lack of public notice, and the difficulty in <br /> addressing the numerous illegal accessory units. <br /> Staff is proposing the above changes to address these concems, including an amnesty <br /> program to provide an opportunity to legalize and bring up to code, including health and <br /> safety standards, many of the illegal units in Redwood City. <br />
