.�� <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager ' <br /> June 12, 2000 <br /> Subject <br /> Accessory Dwelling Unit Ordinance <br /> Recommendation <br /> Review and discuss altemative regulations goveming accessory dwelling units. Direct staff <br /> to prepare Resolution Initiating Proceedings to Amend the Zoning Ordinance to correspond <br /> to Council's determination. <br /> Background <br /> On April 10, 2000, the City Council reviewed the recommended changes to the Accessory <br /> Dwelling Unit Ordinance by the Planning Commission. Those recommended changes * <br /> were: <br /> • Require that the property owner reside in the main unit or second unit. <br /> • Require a conditional use permit and public hearing. <br /> • Allow "tandem" parking in the driveway of the main housing unit to count toward <br /> the required parking for the accessory unit as long as the parking is outside the <br /> required 20 ft. garage setback. <br /> ' These recommendations are different than what is now being proposed. <br /> After testimony and discussion the City Council directed staff to investigate the following <br /> issues: <br /> • Re-examine tandem parking in the required front yard for garages (the 20 ft � <br /> setback), either covered or uncovered. <br /> • Consider increasing the allowable size of the second unit from 640 sq. ft. to 750 sq. <br /> ft. Also consider the relationship of the second unit as a percentage of the main unit <br /> and as related to the size of the lot. <br /> • Require that the property owner occupy the property (either in the main or second <br /> unit) via a deed restriction or other acceptable legal mechanism while allowing <br /> exceptions to this requirement if there are any hardships. <br /> • Notify surrounding owners of the proposed second unit either through a Conditional <br /> Use Permit or a"non-discretionary° permit simitar to newly adopted process for <br /> large family day care homes. <br /> • Investigate the density and concentration of second units per block/neighborhood, <br /> taking into consideration parking supply. <br /> • Examine issues of legalizing some of the approximately 2,000 illegal units through <br /> an amnesty program. <br /> Presented below are the planning issues, various options, and general impacts of these - <br /> changes. The City will deal with illegal garage conversions for additional living space on <br /> a case by case basis as they come to our attention. <br /> . _ _ r ..._. __. � _ <br />
