<br />would not impede the department's ability to respond to emergency calls. <br /> <br />~/') <br /> <br />Conclusion <br />The FEIR has adequately addressed the three issues raised in the appeal: 1) The EIR <br />analyzes a potential mixed-use project with a housing component in Alternative 2. 2) The <br />EIR analyzes the parking needs generated by the project using a professionally accepted <br />model of Shared Parking; and 3) the EIR analyzes cumulative traffic impacts (to 2020) <br />using a methodology that incorporates, not only local, but regional volumes as well. <br /> <br />As noted in the previous discussion regarding the assertion that the Interim Urgency <br />Ordinance was not discussed in the EIR, the proposed project, located in the CBR zoning <br />district downtown, would be exempt from the ordinance because a Development' <br />Agreement (DA) and Disposition and Development Agreement (DDA) would be required <br />as part of the project approval process. Therefore, no discussion is required. <br /> <br />Alternative Actions <br />Under the City's CEQA Procedures (Resolution No. 6886 as amended by Resolution <br />No. 7805), the following alternative actions may be taken by the Council on the appeal: <br /> <br />1. Affirm the certification of the FEIR by the Planning Commission (i.e. deny the <br />appeal); <br />2. Reverse the decision of the Planning Commission to certify the FEIR (i.e. grant the <br />appeal); <br />3. Modify the decision of the Planning Commission by certifying the FEIR with <br />revisions to the text and/or comments as appropriate; or <br />4.
