<br />7. '-82.. <br /> <br />On February 28,2000, the City Council adopted the Strategy to Address Flooding in the <br />Friendlv Acres/East Bavshore and the Centennial Neiflhborhoods. The Council motion <br />adopting the Strategy directed the Mayor and staff to pursue all avenues of support for <br />implementing the projects and programs in the Strategy, including working with neighboring <br />jurisdictions, and federal and state agencies. A major step toward collaborating with the <br />Federal and State agencies occurred on August 3rd with a staff level meeting with <br />representative from the federal Department of Interior, Fish & Wildlife Service, and <br />Environmental Protection Agency, and the State Department of Fish & Game. These <br />agencies are now fully aware of the flooding problems in the neighborhoods and the <br />potential benefit access to Cargill lands can provide in addressing the problem. <br />Additionally, staff met with representatives of the San Francisco District Office of the U.S. <br />Army Corps of Engineers to review the potential assistance under the Corps of Engineers' <br />Section 205 Program (Small Flood Control Project Program). The initial step in this <br />process is a reconnaissance analysis to determine if the program meets Army Corps <br />criteria for federal intervention. Our efforts with the federal/. state agencies and with the <br />Army Corps of Engineers are two distinctly independent courses of action. The latter <br />activity, with the Army Corps of Engineers, is to pursue federal funding through an existing <br />federal program designed specifically to address flooding control and could require some <br />investment of city funds (via City Council approval), if found to merit federal involvement. <br />This process could be helpful particularly if negotiations between the agencies and Cargill <br />do not result in a change of ownership. <br /> <br />The resolution will demonstrate the City's resolve to sensitize and influence others (federal <br />and state agencies) to consider our critical flood control needs in their negotiation process. <br /> <br />Alternative <br />There are no reasonable alternatives for the City to consider at this time. The City is not <br />a party to the negotiations with Cargill; therefore, it cannot directly intervene in the process. <br />Any other alternative, Le. acquisition of the property or condemnation using City resources, <br />would have unknown fiscal impact and may not be feasible because of the Federal <br />involvement in the present acquisition process. <br /> <br />Fiscal Impact <br />There is no fiscal impact to any City funds resulting from adopting the resolution as <br />described above. A funding source will have to be determined if the Federal and State <br />governments agree to the use of the property it purchases as described above and <br />improvements to facilitate the flood control use become necessary. However, we do not <br />have an estimate of these costs at this time. <br /> <br />Marilyn W.
