On Block 2, Alternative 4 proposes an office building, consisting of <br />approximately 108,400 square feet (instead of a specialty foods market) and a 1,000-space <br />parking structure. <br /> <br />4. On January 18,2000, the Planning Commission conducted a public scoping session to <br />determine the scope of the environmental review for the Project at which time it solicited <br />comments from the responsible agencies, other concerned public bodies (e.g., adjacent <br />jurisdictions) and members of the public prior to preparation of an Initial <br />StudylEnvironmental Checklist for the Project. <br /> <br />5. On February 1, 2000, the Planning Commission conducted a 2nd public scoping session for <br />the environmental review ofthe Project. <br /> <br />6. On March 3, 2000, a Notice of Preparation ("NOP") was filed with the State Clearinghouse <br />indicating the City's intent to prepare an environmental impact report (EIR). The NOP <br />provided a brief description of the project, established a public review period to be completed <br />on August 31, 2000 and announced public hearings to be held at the Planning Commission <br />meetings of August 1 and August 15,2000. . <br /> <br />7. On July 18,2000, a Draft Environmental Impact Report (DEIR) was prepared and circulated <br />for a 45-day public review period which closed on August 31, 2000. <br /> <br />8. On August 1,2000, the Planning Commission held a public hearing on the DEIR. <br /> <br />9. On August 15,2000, the Planning Commission held a 2nd public hearing on the DEIR. <br /> <br />10. On or about October 9, 2000 a Final EIR (FEIR) was prepared which included responses to <br />comments made during the 45-day public review period, which FEIR was made available to <br />the public. <br /> <br />11. On October 17, 2000, the Planning Commission conducted a public hearing on the FEIR for <br />the proposed Downtown Retail-Cinema project. At that meeting the Commission discussed <br />and considered the proposed Final EIR, including responses to comments, further <br />insignificant changes, and found that it had been prepared and completed in accordance with <br />CEQA, the State CEQA Guidelines and the County's CEQA Ordinance. The Commission <br />determined that the FEIR met the requirements of the California Environmental Quality Act <br />(CEQA) and voted to certify the FEIR based on the following findings: <br /> <br />. <br /> <br />The FEIR had been completed in compliance with CEQA. <br />The FEIR was presented to the decision-making body of the lead agency (City) and <br />that the decision-making body reviewed and considered the information contained in <br />the Final EIR prior to approving the project. <br />The Final EIR reflects the lead agency's independent judgment and analysis. <br /> <br />. <br /> <br />. <br /> <br />2 <br /> <br />'r""-"" "'~'-'T <br />
