��� <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> December 18, 2000 <br /> Subject -_ <br /> Findings and Conclusions on Appeal of Planning Commission Certification of the Final <br /> Environmental Impact Report for the proposed Downtown Retail-Cinema project. <br /> Recommendation <br /> By motion, approve the Findings and Conclusions on the Appeal of the Planning <br /> Commission's Certification of the Final Environmental Impact Report for the proposed <br /> Downtown Retail-Cinema project. <br /> Background <br /> On November 13, 2000, after a duly noticed public hearing, full consideration of all public <br /> testimony including testimony by the appellant, and based upon the Draft Environmental <br /> Impact Report (DEIR) and the Final Environmental Impact Report (FEIR) and substantial <br /> evidence in the Administrative Record, the City Council denied the appeal of the Planning <br /> Commission Certification of the Final Environmental Impact Report for the proposed <br /> Downtown Retail-Cinema project and directed staff to prepare the appropriate findings <br /> consistent with its decision. <br /> Attached please find a copy of the findings and conclusions as requested, prepared by <br /> CEQA Special Counsel, the Law Offices of William A.
