During the environmental review process an "Altemative 4" was developed which <br /> would be almost.identical to the proposed project on Block 1, covering the block with <br /> a two-story mixed-use building that is occupied by retail stores and restaurants on <br /> the ground floor, consisting of approximately 80,453 square feet, and a 20-screen, <br /> 4,200-seat cinema complex on the second floor. On Block 2, Alternative 4 proposes <br /> an office building, consisting of approximately 108,400 square feet (instead of a <br /> specialty foods market) and a 1,000-space parking structure. <br /> 4. On January 18, 2000, the Planning Commission conducted a public scoping session <br /> to determine the scope of the environmental review for the Project at which time it <br /> solicited comments from the responsible agencies, other concerned public bodies <br /> (e.g., adjacent jurisdictions) and members of the public prior to preparation of an <br /> Initial Study/Environmental Checklist for the Project. <br /> 5. On February 1, 2000, the Planning Commission conducted a 2" public scoping <br /> session for the environmental review of the Project. <br /> 6. On March 3, 2000, a Notice of Preparation ("NOP") was filed with the State <br /> Clearinghouse indicating the City's intent to prepare an environmental impact report <br /> (EIR). The NOP provided a brief description of the project, established a public <br /> review period to be completed on August 31, 2000 and announced public hearings <br /> to be held at the Planning Commission meetings of August 1 and August 15, 2000. <br /> 7. On July 18, 2000, a Draft Environmental Impact Report (DEIR) was prepared and <br /> circulated for a 45-day public review period which closed on August 31, 2000. <br /> 8. On August 1, 2000, the Planning Commission held a public hearing on the DEIR. <br /> 9. On August 15, 2000, the Planning Commission held a 2" public hearing on the <br /> DEIR. <br /> 10.On or about October 9, 2000 a Final EIR (FEIR) was prepared which included <br /> responses to comments made during the 45-day public review period, which FEIR <br /> was made available to the public. <br /> 11.On October 17, 2000, the Planning Commission conducted a public hearing on the <br /> FEIR for the proposed Downtown Retail-Cinema project. At that meeting the <br /> Commission discussed and considered the proposed Final EIR, including responses <br /> to comments, further insignificant changes, and found that it had been prepared and <br /> completed in accordance with CEQA, the State CEQA Guidelines and the County's <br /> CEQA Ordinance. The Commission determined that the FEIR met the requirements <br /> of the California Environmental Quality Act (CEQA) and voted to certify the FEIR <br /> based on the following findings: <br /> • The FEIR had been completed in compliance with CEQA. <br /> 2 <br /> _ . r .__. __..._. _ .._ <br />
